Uncontested Divorce
If you and your spouse have resolved all issues between the two of you regarding property and support, and you simply want a divorce, what you are looking for is called an "uncontested divorce."
An uncontested divorce ends your marriage, freeing you to close an old chapter of your life, and to move on to a new one.
Before you start your uncontested divorce, please review the requirements:
- We only handle uncontested divorces. We do not provide you with any legal advice as to your family law rights and obligations.
- The Divorce Act recognizes three main grounds for divorce, which are: cruelty, adultery, or being separated for one year.
- You or your spouse must have lived in Alberta for the last year.
- You must know where your spouse is living.
- There must be no arguable issues -- such as child custody, support or property division -- that needs to be resolved between you and your spouse.
- If the divorce is contested, then you need to seek the advice of a lawyer, and/or we can refer you to a lawyer.
