Civil Claims

Be aware that the Statute of Limitations states you have only two (2) years to sue someone.  That is two years from the date of the invoice or the date the contract was breached.  As well, if there was a partial payment, then the two years begins from the dated they last acknowledged the debt, so the day the partial payment was made.  There are a number of matters that can be dealt with in this Court.  They include motor vehicle accidents, general damages, contracts, and debts.

With PPSC's document preparation service we help you by first preparing a Demand Letter to request payment of the debt.  If there is no response to the Demand Letter, PPSC will then help you prepare your Civil Claim and all related documents, which will be file with Provincial Court – Civil Division.

After the claim has been filed PPSC will make sure the documents are served in the way that has been directed by the Courts.  If the opposing party responds by filing their Dispute Note you will receive a Court date.  If they do not respond within the specific time frame, as outlined by the Courts, you will automatically receive your judgment once the Affidavit of Service has been filed.  If you have received a trial date we can help you prepare for your Court appearance (or in some instances, even attend with you).

Once you have received your Judgment PPSC can assist you by preparing all the documents required for collection; registration of Judgment at Queen's Bench, Liens, Writs, Garnishee and even to hire a Sherriff to seize assets, if necessary.

Civil Court hears all civil claims, subject to Provincial Statutory restrictions.  The Court can hear claims up to $25,000.  Anything over that amount will have to be filed in the Court of Queen’s Bench and it is then in your best interest to consult a lawyer.

Civil Court also hears applications regarding landlords and tenants under the Residential Tenancies Act and Mobile Home Sites Tenancies Act.

Civil court also hears applications for landlords and tenants under the Residential Tenancies Act and Mobile Home Sites Tenancies Act.  The court can hear applications up to $25,000, subject to some restrictions.

  • Claims up to $7,500 have a $100 filing fee.
  • Claims over $7,500 and up to $25,000 have a $200 filing fee.
