Commissioner for Oaths

A Commissioner is a person authorized to take your oath or solemn affirmation when you sign an affidavit or a statutory declaration.  A Commissioner does not certify that the statements being made in the affidavit or statutory declaration are true, but only certifies that an oath or solemn affirmation has been administered properly.  A Commissioner of Oaths can only commission documents which are being filed within the Province in which the Commissioner received his or her appointment.

Notary Public has much broader authority.  A Notary can "Notarize" copies of documents (verify as a true copy).  Notaries can notarize documents for filing throughout the world.

Travel Letters

It is strongly urged that children travelling and crossing international borders without both parents carry a consent travel letter for each and every trip abroad.  Although anyone can witness and sign these letters, it is wise to have the consent letter certified, stamped or sealed by a person who has the authority to administer an oath or solemn declaration.  For example: a commissioner for oaths, notary public, lawyer, etc. so that the validity of the consent travel letter will not be questioned.

Land Transfers:

  • We prepare the land transfer and dower release.
  • We arrange for both spouses to sign the land transfer in our office.
  • The spouse that is giving up their interest in the matrimonial home must sign the Dower Release in the presence of a lawyer.  Return the signed Dower Release to our office and we file the Land Transfer and Dower Release.
  • We do not help with the transfer of any payment for the land transfer.  This is worked out between the parties or with the help of their lawyers.
